- The ruling comes after several lawsuits challenged a March proclamation by Trump that described Tren de Aragua as unlawfully entering the U.S. And asserted authority to carry out deportations of alleged gang members without standard judicial review.
- Haines revoked the class action designation she had previously granted and mandated that the administration notify individuals in both English and Spanish at least three weeks in advance before deportations can proceed, giving them a chance to raise any objections.
- Trump’s proclamation designates the Venezuelan gang Tren de Aragua as a terrorist group and authorizes the removal of Venezuelan nationals aged 14 and older who lack legal immigration status and are linked to this gang, with deportees being sent to a well-known prison in El Salvador.
- Haines noted significant constitutional issues remain and that her ruling does not clarify use of the Act for other immigration laws or non-terrorist migrants, leaving further decisions to political branches and voters.
