The District Court acquitted Kuusemaa of the charge of desecration of a corpse.

The Tallinn District Court agreed with the Pärnu County Court that Kairi Kuusemaa was guilty of killing her newborn child. However, the District Court overturned the County Court's decision regarding desecration of a corpse and acquitted Kuusemaa of that charge.

The district court found that Kairi Kuusemaa killed her child by suffocating him.
